This End User License Agreement ("EULA") is between you and Fluxera ("we", "us") for the Movio application ("the Licensed Application"). By downloading or using Movio you agree to this EULA. The Licensed Application is licensed, not sold, to you.
This EULA incorporates the Apple Licensed Application End User License Agreement (available at apple.com/legal/internet-services/itunes/dev/stdeula). This EULA supplements those terms; where both apply, the Apple minimum required terms set the floor. To the extent any provision of this EULA conflicts with a required Apple provision, the Apple provision controls.
We grant you a personal, limited, non‑exclusive, non‑transferable, revocable license to install and use Movio on any Apple‑branded device that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service. This license does not allow you to use Movio on a device you do not own or control, and you may not distribute or make it available over a network where it could be used by multiple devices at once.
You may not copy (except as expressly permitted), decompile, reverse‑engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of Movio, except to the extent that such restriction is prohibited by applicable law.
By using Movio you acknowledge that we collect and use limited data as described in our Privacy Policy, including the legal bases for that processing. We do not use your data for advertising and do not sell it. The Privacy Policy forms part of the agreement between you and Fluxera.
Movio displays film information, artwork and trailers supplied by The Movie Database (TMDB). This content belongs to its respective owners; this product uses the TMDB API but is not endorsed or certified by TMDB. Your use of third‑party content is subject to the terms of those providers.
To the maximum extent permitted by law, the Licensed Application is provided "as is" and "as available", without warranty of any kind, and your use of it is at your sole risk. If the Licensed Application fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the Licensed Application. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Licensed Application; all claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are Fluxera's sole responsibility.
To the extent not prohibited by law, in no event will Fluxera be liable for personal injury or any incidental, special, indirect, or consequential damages arising out of or related to your use of Movio.
Fluxera, not Apple, is responsible for addressing any claims by you or any third party relating to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. In the event of any third‑party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, Fluxera — not Apple — is solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
Apple and its subsidiaries are third‑party beneficiaries of this EULA and, upon your acceptance, will have the right to enforce it against you. Apple has no obligation to furnish any maintenance or support for Movio.
This license is effective until terminated by you or by us. Your rights end automatically if you fail to comply with any term. On termination you must stop using Movio; you can delete your account and data at any time from Settings → Delete account.
This EULA is governed by the laws of the Republic of Türkiye, subject to any mandatory rights you have as a consumer where you live.
